Square told its merchants this month to strip CBD and hemp-derived products out of their catalogs by October 15, after which those items are no longer permitted on the platform. That is 59 days from today. The federal hemp beverage ban everyone has been counting down to is 87 days out, and Congress is actively trying to move it.
The gap between those two numbers is the whole story. Legislative deadlines slip. Payment processors, distributors, and retail chains set their own cutoffs, and they set them early.
The hemp provision enacted last year narrows the federal definition of hemp on November 12, capping products at 0.4 mg of total THC per container and banning synthesized cannabinoids. At that threshold, a standard 5 mg or 10 mg seltzer stops being hemp.
The Senate then passed a stopgap funding bill on August 8 that pushes the date to December 11, voting 61-32 to table an amendment that would have stripped the delay out. The House passed its own version on July 20 with no hemp extension in it, and the two chambers have not reconciled.
So the official answer to "when does this happen" is currently November 12, or December 11, or later if the Beverage Regulatory Parity Act from Reps. Beth Van Duyne and Greg Landsman gets traction. That bill would regulate hemp drinks through a three-tier alcohol-style system, and alcohol retailers and wholesalers have publicly backed it.
None of that ambiguity helps a brand with inventory in a warehouse. Square is not waiting for the conference committee, and neither are the chains deciding next quarter's planograms.
Reformulate under 0.4 mg. Technically available, commercially thin. A beverage at a fraction of a milligram of total THC is a different product with a different reason to exist, and the brands that built on 5 mg and 10 mg doses would be starting the category over.
Exit the category. The path Square just made easier by default. Merchants who cannot find replacement processing before October 15 exit whether they planned to or not.
Move into licensed cannabis. Several states already forced this. California's AB 8 pushed most hemp THC beverages into the licensed dispensary system effective January 1. New Jersey's rule takes effect November 14 and treats any hemp beverage over 0.4 mg total THC as cannabis, producible only by a licensed Class 2 manufacturer and sellable only through a licensed Class 5 retailer.
The traffic has been running the other way for years. Cann left the regulated market for hemp in 2022 and now reaches thirty states through liquor stores, convenience stores, and bars. Curaleaf, a licensed operator, went the same direction. What is happening now is that lane closing while the dispensary lane stays open.
Volume that has been moving through smoke shops, bottle shops, and gas stations is going to land in licensed dispensaries or disappear. For a vendor, that shifts the target list rather than shrinking it.
Payment and POS providers have a live displacement window right now, because every Square merchant with a hemp SKU is shopping before October 15. Distributors and brokers with liquor-channel relationships and no cannabis license are about to lose a product line. Packaging, compliance, and testing vendors pick up accounts instead, because a product crossing into the licensed system inherits child-resistant packaging rules, state-mandated testing, and track-and-trace obligations it did not have as hemp.
Dispensary buyers are the ones who decide which reformulated or relicensed brands get a slot. Anyone planning to reach them in Q4 is competing with every hemp brand making the same trip.
This is a fast-moving statutory picture and the dates in it are still in play. Operators making inventory or licensing decisions should confirm the current status with counsel rather than a news cycle.
